Terms & Conditions

Introduction

These Terms and Conditions govern the supply of marine and industrial services by AL MUQIM Marine Services L.L.C ("we", "us", "our") of Office #104, Al Bustan Building, Ajman — UAE, and the use of the website www.almuqimmarine.com. By requesting a quotation, placing an order, or using this website, you ("the Client") accept these terms.

Where a signed contract, framework agreement or purchase order exists between us and the Client, that document takes precedence over these terms to the extent of any conflict. Any terms the Client seeks to impose that differ from these do not apply unless we have accepted them in writing.

Services and Quotations

We provide tank cleaning, chipping and painting, hydro blasting, sludge disposal, marine manpower supply and related industrial services, as described on this website and set out in the quotation issued for each job.

Scope of work

Each quotation defines the scope of work, the vessel or site, the expected duration and the price. Work outside that scope is a variation and is chargeable at the rates quoted at the time, subject to written agreement before it is carried out.

Validity

Unless stated otherwise on the quotation itself, quotations remain valid for thirty (30) days from the date of issue and are subject to the availability of crew, equipment and berth or site access at the time of acceptance.

Acceptance

A contract is formed when the Client accepts a quotation in writing, issues a purchase order referring to it, or instructs us to begin work. Enquiries submitted through this website are requests for a quotation and do not by themselves create a contract.

Client Obligations

Safe and efficient marine work depends on the Client providing accurate information and safe conditions. The Client is responsible for:

  • Providing safe, timely and uninterrupted access to the vessel, tank or site for the agreed period
  • Disclosing the nature of any previous cargo, residue, coating or substance our crew may encounter
  • Obtaining port entry, hot work, confined space and any other permits required by the authority having jurisdiction
  • Confirming that tanks and spaces are gas free and certified safe for entry before our crew enters them
  • Supplying utilities agreed in the quotation, such as water, power, lighting and waste reception
  • Nominating a representative authorised to approve variations and sign off completed work

Where access, permits or conditions are not as agreed, standby time is chargeable and the completion date moves accordingly.

Health, Safety and Environment

We work to recognised marine industry safety practice and to the requirements of the port and the authority having jurisdiction. Our crew carry the personal protective equipment appropriate to the work and follow confined space, working at height and hot work procedures as applicable.

We reserve the right to stop or refuse work where conditions are unsafe, where a required permit or gas free certificate is absent, or where an instruction would place our crew or the environment at risk. Time lost for these reasons is not our liability.

Waste, sludge and residues collected during our work are handled and transferred to licensed reception facilities in accordance with applicable regulations. Documentation is provided to the Client on request.

Prices and Payment

  • Prices are quoted in United Arab Emirates Dirhams (AED) unless stated otherwise
  • Prices exclude Value Added Tax and any port, customs or authority charges, which are billed at cost
  • Invoices are payable within thirty (30) days of the invoice date unless the quotation states different terms
  • Mobilisation, standby, waiting time and overtime are chargeable at the rates set out in the quotation
  • Payment is made without set-off or deduction, and title in any material supplied passes only on payment in full

Where an invoice remains unpaid after its due date, we may suspend further work and charge interest on the outstanding amount at the rate permitted by law. The Client remains liable for reasonable costs of recovery.

Liability and Insurance

We maintain the insurance cover appropriate to the services we provide, including public liability and workmen's compensation for our crew. Evidence of cover is available to the Client on request.

Limits

Our total liability arising from any single job, whether in contract, tort or otherwise, is limited to the value of that job as stated in the accepted quotation. We are not liable for loss of profit, loss of hire, loss of use, demurrage, or any indirect or consequential loss however arising.

Exclusions

We are not liable for damage arising from pre-existing corrosion, defective coatings, latent defects, inaccurate information supplied by the Client, or conditions that could not reasonably have been identified before work began.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud, or for any liability that cannot lawfully be excluded.

Cancellation, Delay and Force Majeure

Either party may cancel a job in writing before work begins. Where the Client cancels after crew or equipment has been mobilised, the costs already incurred are chargeable.

Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including severe weather, port closure, strike, act of government, sanctions, or the unavailability of berth or reception facilities. Where such an event continues for more than thirty (30) days, either party may cancel the affected job without further liability, save for work already performed.

The content of this website, including text, photographs, logos and layout, belongs to us or to our licensors and may not be copied, reproduced or republished without written permission. Client and partner logos shown on this website remain the property of their respective owners and are displayed with permission.

Governing Law and Contact

These terms are governed by the laws of the United Arab Emirates. The parties will attempt to resolve any dispute in good faith; failing that, the courts of the Emirate of Ajman have jurisdiction.
